The Coalition of Civil Society Network described the ruling by Justice Obiora Egwuatu as unfair and contrary to democratic principles, urging the judiciary to consider the will of the people in its final decision.
Justice Egwuatu had ruled that Gummi’s defection was morally wrong, stating that voters elect candidates based on party manifestos and ideals, making it unacceptable for an official to abandon the platform that sponsored them. The court ordered Gummi to refund all salaries and allowances received since October 30, 2024, and directed INEC to conduct a fresh election within 30 days.
The PDP and its Zamfara State chairman had filed the suit, arguing that Gummi’s defection violated constitutional provisions, as there was no division in the PDP to justify his move.
However, the coalition’s convener, Lukman Muhammad, argued that Gummi’s defection resulted from unresolved internal crises in the PDP, which hindered his ability to represent his constituents effectively. He emphasized that the judgment could set a dangerous precedent, undermining fair representation and lawmakers’ constitutional rights to freedom of association.
The coalition urged a review of the ruling, warning of its broader implications for Nigeria’s democracy and the rights of elected officials to choose their political affiliations.
